Acceptance

These terms of service apply to all Booking Board customers. Acceptance of these terms is a prerequisite for using Booking Board. End users (Booking Board’s customers' customers) do not need to comply with these terms of service. Instead, end users must accept the terms of service of Booking Board’s customers when they create a profile with them.

Payment

Payment for Booking Board is always made in advance. Booking Board issues an invoice that must be paid within 14 days from the start of the billing period. However, if the invoice is sent after the start of the billing period, the payment deadline is 14 days from the invoice date. Booking Board will attempt to automatically charge the payment via the customer’s linked payment card in Stripe. If payment is not received within 14 days, Booking Board has the right to restrict access to the system. However, we will always first ensure that the payment has not failed due to an error.

Termination

The customer may terminate the agreement at any time without notice and choose whether the system should remain active until the end of the paid period or be shut down immediately. The binding period of a rolling month plus one additional month applies from the agreed start date or when the first invoice is paid. Under normal circumstances, Booking Board may terminate the agreement with three months' notice without further justification. If Booking Board has knowledge or reasonable suspicion that the customer is misusing the system for purposes other than its intended use (booking and payment for classes, courses, and products) or if the customer's use of the system causes it to become unusually slow or otherwise unusable for other Booking Board customers and does not change their practices upon request, Booking Board may terminate the agreement with immediate effect. If Booking Board terminates the agreement before the paid period expires, Booking Board will refund the remaining months.

There is a 6-month binding period for the Pay as you grow package solution. After 6 months, Pay as you grow transitions to a rolling month plus a one-month binding period.

Confidentiality

The data collected in Booking Board through the customer's and end users' use of the system belongs to the customer. Booking Board has no rights to this data, and upon termination of the agreement, the data will be deleted from the system. Booking Board will never disclose or sell data to third parties without the customer’s explicit consent. Booking Board employees are obligated not to share information about either Booking Board's customers or Booking Board’s customers' customers. See also the Data Processing Agreement, which is an appendix to these Terms of Service.

Security

Booking Board maintains a security level appropriate to the types of information the system processes. This includes basic personal data such as name, address, etc., as well as information about purchases, registrations, etc., but does NOT include highly sensitive personal data such as health information, social security numbers, race, sexuality, etc. Booking Board also does not process credit card numbers; these are handled by third-party payment providers, such as Billwerk+ or Stripe.

Limitations of Booking Board’s Liability

Booking Board makes every effort to ensure the integrity and confidentiality of our customers' data and the uptime of the system. However, we cannot guarantee 100% uptime or completely eliminate errors. The customer acknowledges that Booking Board cannot, under any circumstances, be held liable for damages (financial, legal, reputational, etc.) that the customer may suffer due to errors in Booking Board or its subcontractors.
